Terms of Service

These Terms govern your access to and use of the Service. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Service provides AI-assisted pipeline diagnosis and go-to-market planning for B2B technology companies. The Service operates on a bring-your-own-key (BYOK) basis: you supply your own Anthropic or OpenAI API key, and the Service uses it to generate AI outputs. You are responsible for your API key, for your account with your AI provider, and for any usage charges that provider bills you. We do not mark up, resell, or bill you for AI provider usage — that is strictly between you and your provider.

2. Not professional advice

The Service is a decision-support tool, not a professional advisor. Its outputs are generated by an AI model to assist your own analysis and judgment. They are not professional advice of any kind — including financial, investment, legal, accounting, tax, or management-consulting advice — and we are not your advisors, consultants, or fiduciaries.

• AI outputs may be incomplete, inaccurate, outdated, or wrong.
• You are solely responsible for evaluating the outputs and for any decision you make or action you take based on them.
• You must independently verify any output before relying on it for business, financial, strategic, personnel, or other decisions.
• Nothing the Service produces creates any advisory or fiduciary relationship between you and us.

You use the Service's outputs at your own risk and on your own judgment.

3. Eligibility and accounts

You must be at least 18 years old and using the Service for business purposes. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate sign-up information and to confirm your email address when prompted.

4. Access, beta status, and access codes

The Service is currently offered on a beta basis. Access may be granted through single-use access codes that provide a defined period of access (the current grant period is shown to you at redemption). You agree not to share, resell, or transfer access codes. Beta access may be modified, limited, or discontinued, and features may change, as we develop the Service.

Because the Service is in beta, it is provided "as is" and may contain errors, produce imperfect outputs, or experience interruptions. We make no guarantee of uptime, accuracy, or fitness during the beta period.

5. Pricing and payment

Access to the Service may be provided free of charge (for example, via access codes) or under a paid plan. Where a plan is paid, the price and billing terms are those presented to you in the Service at the point of purchase. We may introduce, change, or withdraw pricing and plans. Any AI provider usage charges remain your responsibility regardless of what you pay (or don't pay) for the Service.

6. Your content and responsibilities

• Your content. You retain ownership of the information you enter into the Service ("Your Content"). You grant us only the limited rights needed to operate the Service for you — to store, process, and display Your Content back to you, and to transmit it to your AI provider using your key to generate outputs you request.
• Acceptable use. You agree not to use the Service to violate any law, infringe others' rights, attempt to breach the Service's security or access other users' data, reverse-engineer the Service, or use it to generate unlawful, harmful, or abusive content.

7. Intellectual property

We retain all rights in the Service itself — its software, design, and underlying methodology. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your access period. As between you and us, you own the outputs generated from Your Content, subject to your AI provider's terms governing the model that produced them.

8. Privacy

Our handling of your data is described in our Privacy Policy, which is incorporated into these Terms. In summary: we use your own API key for AI calls, we use no tracking or analytics, we do not sell your data, we encrypt your stored key, we isolate your data to your account, and you can delete your sessions or your entire account from within the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE OR RELIABLE. THIS IS PARTICULARLY TRUE DURING THE BETA PERIOD.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Arun Keshav Cavale (OPERATING AS "GROWTH FORGE ASIA") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR YOUR RELIANCE ON ANY OUTPUT. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) USD 100.

You acknowledge that AI provider charges are your responsibility, and we are not liable for usage charges billed to you by Anthropic, OpenAI, or any provider whose key you supply.

11. Indemnification

You agree to indemnify and hold harmless Arun Keshav Cavale (operating as "Growth Forge Asia") from claims arising out of your misuse of the Service, your violation of these Terms, your reliance on the Service's outputs, or your violation of any law or third-party right.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including the not-professional-advice disclaimer, warranty disclaimers, liability limits, and indemnity) survive.

13. Governing law

These Terms are governed by the laws of Singapore, without regard to conflict-of-laws principles.

14. Changes to these Terms

We may update these Terms. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
